Terms of Service – Genmuse

1. Acceptance of Terms

By accessing and using Genmuse, you accept and agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these Terms, you may not use our services.

2. Description of Service

Genmuse is an evolutionary search engine using artificial intelligence and human collaboration to create innovative works of art. It serves as a creative platform for both individual users and professionals to discover, create, evolve, and share artistic content.

4. Registration and Access

Users may register for free via Google Single Sign-On (SSO). Upon registration, users receive 15 complimentary art generations.

After this free period, users can select from the following subscription plans:
- Pay-As-You-Go: $0/month - $0.10/artwork - public artworks
- Standard: $5/month - $0.15/artwork - private artworks
- Premium: $25/month - $0.05/artwork - private artworks

Payments are securely processed via Stripe (Credit Card only). Prices displayed exclude VAT. VAT is managed dynamically by Stripe according to the user’s country of residence.

5. Features of Genmuse

Genmuse provides users with:
- Discover: Semantic search engine for artistic inspiration.
- Find Similar Artworks: Save favorites, receive personalized recommendations, and build your private collection.
- Create & Evolve: Generate new artworks or evolve existing pieces using AI-driven tools.
- Community: Interact with a community of creators, view, share, and explore public artworks.

6. User Conduct and Restrictions

When using Genmuse, you agree to:
- Not generate or share inappropriate, offensive, harmful, or illegal content.
- Not spam or abuse the API, services, or platform.

We reserve the right to immediately suspend or terminate any account violating these rules without prior notice.

7. Intellectual Property and Content Ownership

  • Ownership: Users retain ownership and intellectual property rights to the artworks generated through Genmuse provided they are Standard or Premium subscribers.
  • Public Works: Users under the “Pay-As-You-Go” or free trial plans acknowledge that generated artworks are public and may be viewed, used, shared, and promoted by Genmuse.

Genmuse reserves the right to showcase, communicate, promote, or use publicly generated artworks for marketing, promotional, or demonstrative purposes without any additional permission or compensation to the user.

8. Liability and Warranty

Genmuse services are provided “as is”. We strive to maintain a high-quality and consistent experience but explicitly disclaim liability arising from:

  • Service interruptions, delays, latencies, or errors.
  • Maintenance downtime or third-party AI model (LLM) availability.
  • Loss of data or indirect damages.

You agree that your use of the service is at your sole risk.

9. Subscription, Cancellation, and Refunds

  • No Commitment: Subscriptions can be canceled at any time via your account settings or through your Stripe billing page.
  • Refund Policy: Unless otherwise required by law, payments are non-refundable, and no partial refunds or credits are given for unused generations.

10. Privacy and Personal Data (GDPR)

We respect your privacy. When registering via Google SSO, we collect basic user data (email, name, etc.). Financial transactions are securely processed through Stripe.

Personal data is stored securely on servers located within the European Union.

We use Google Analytics cookies for user-experience improvements. By using Genmuse, you consent to our use of cookies according to our Privacy Policy.

12. Modifications of Terms

We reserve the right to modify these Terms of Service at any time. Changes will become effective immediately upon publication. Your continued use of Genmuse following any changes implies your acceptance of the new Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by French law.

In the event of a dispute arising out of these Terms, users agree to first contact us directly at contact@genmuse.io to seek an amicable resolution. If no amicable solution is found, disputes will be submitted to the jurisdiction of the competent courts in France, in accordance with applicable French law.
